Terms of Service

Overview

This website is operated by Spine & Vine. Throughout the website, the terms “we”, “us” and “our” refer to Spine & Vine.

These Terms of Service apply when you visit our website or purchase something from us. By accessing the website or placing an order, you agree to these terms together with our Privacy Policy, Shipping Policy, and Return and Refund Policy.

Please read these terms carefully before using the website. If you don’t agree to them, you shouldn’t use the website or place an order.

About our store

Spine & Vine is an online retailer based in Scotland, United Kingdom.

You can contact us at:

Using our website

You must use our website only for lawful purposes. You must not:

  • Use the website for fraudulent or unlawful activity
  • Attempt to interfere with the security or operation of the website
  • Introduce viruses, malicious code, or other harmful material
  • Copy, reproduce, or exploit website content without permission
  • Provide false or misleading information when placing an order

We may suspend or restrict access to the website if we reasonably believe it is being misused.

Products and descriptions

We take reasonable care to describe and display our products accurately. However, colours and appearance can vary depending on your screen or device.

Product packaging, presentation, or individual contents may occasionally vary where necessary, but we will not make a material substitution without making this clear or obtaining your agreement where appropriate.

All products are subject to availability. We may limit the quantities available for purchase or withdraw a product from sale at any time.

Prices

All prices are displayed in pounds sterling unless stated otherwise.

Spine & Vine is not currently VAT-registered, so we don’t charge UK VAT separately. Delivery charges are displayed during checkout before you complete your purchase.

We try to ensure that prices are accurate. If we discover an obvious pricing error after you place an order, we will contact you and give you the option to proceed at the correct price or cancel the order for a full refund.

Orders

Submitting an order is an offer to purchase the products in your basket. You will receive an order confirmation after checkout, but this doesn’t necessarily mean that we have accepted your order.

A contract is formed when we confirm that your order has been accepted or dispatched.

We reserve the right to decline or cancel an order for legitimate reasons, including:

  • A product being unavailable
  • Incorrect pricing or product information
  • Payment not being authorised
  • Suspected fraud or misuse
  • An inability to deliver to the address provided

If we cancel an order after payment has been taken, we will issue a full refund.

Payment

Payment must be made using one of the payment methods available at checkout. Payments are processed securely by Shopify and the relevant payment provider.

You confirm that you are authorised to use the payment method supplied with your order.

Shipping and delivery

We currently deliver within the United Kingdom.

Available delivery options, prices, and estimated timeframes are described in our Shipping Policy and shown at checkout. Delivery estimates aren’t guaranteed, although we will take reasonable steps to dispatch and deliver orders on time.

You are responsible for providing a complete and accurate delivery address. Contact us promptly if you notice an error. We can’t guarantee that an address can be changed after an order has been dispatched.

Returns, cancellations, and refunds

Your rights to cancel an order, return products, and receive a refund are explained in our Return and Refund Policy.

Nothing in these terms limits your legal rights under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, or other applicable consumer law.

Damaged, faulty, or incorrect products

Please inspect your order after delivery. If an item is damaged, faulty, or different from what you ordered, contact contactspineandvineshop@gmail.com as soon as possible with your order number and relevant photographs.

We will handle faulty or incorrectly supplied goods in accordance with your statutory rights.

Gift messages and customer-supplied content

If you provide a gift message or other content for inclusion with an order, you are responsible for ensuring that it is accurate, lawful, and not abusive, discriminatory, threatening, or otherwise inappropriate.

We may refuse to include content that we reasonably consider unsuitable.

Intellectual property

The content of this website, including its branding, text, graphics, photographs, product descriptions, and design, belongs to Spine & Vine or is used with permission.

You may view the website for personal, non-commercial use. You must not reproduce, distribute, modify, or commercially exploit its content without our prior written permission.

Our website may include links to or features supplied by third parties, including payment providers, delivery companies, and social media platforms.

We aren’t responsible for the content, availability, or privacy practices of third-party websites. Your use of third-party services may be subject to their own terms and policies.

Website availability

We aim to keep the website accurate and available, but we don’t guarantee that access will always be uninterrupted or error-free.

We may update, suspend, or withdraw parts of the website for maintenance, security, or business reasons.

Liability

We don’t exclude or limit liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or breach of your statutory consumer rights.

We aren’t responsible for losses that weren’t reasonably foreseeable when the contract was formed, or for business losses arising from a purchase made for personal use.

Privacy

Our collection and use of personal information are explained in our Privacy Policy.

Changes to these terms

We may update these Terms of Service from time to time. The version published on the website when you place an order will normally apply to that purchase.

Governing law

These terms are governed by the laws of Scotland.

If you are a consumer living elsewhere in the United Kingdom, you also retain any mandatory rights and legal protections that apply where you live. Nothing in these terms prevents you from bringing a claim in a court available to you under applicable consumer law.
